Kelunip provides family-centered wellness services designed for multi-generational participation. Our services include fitness programs, mindfulness activities, outdoor adventures, nutritional guidance, and community support tailored for families with members aged 40 and above.

Our Services Include:

3. Eligibility and Registration

Our services are designed for families and individuals who can safely participate in gentle wellness activities. While we welcome participants of all ages, our programs are specifically designed for adults 40 years and older.

Eligibility Requirements:

• Must be physically capable of participating in gentle movement activities
• Must provide accurate health information relevant to safe participation
• Must obtain medical clearance if required by our assessment
• Must be able to follow instructor guidance and safety protocols
• Minors must have parental consent and supervision

When registering for our services, you agree to provide accurate, current, and complete information about yourself and your family members who will participate. You are responsible for maintaining the security of your account credentials.

We reserve the right to refuse service to anyone for any reason at any time, including if we determine that participation would pose safety risks to the individual or other participants.

4. Health and Safety Responsibilities

Participation in physical activities carries inherent risks. You acknowledge and understand these risks and agree to participate at your own risk. Your safety and the safety of other participants is our highest priority.

Your Responsibilities:

• Inform us of any health conditions that may affect your participation
• Follow all safety instructions and program guidelines
• Stop activity immediately if you experience discomfort or distress
• Obtain medical clearance before participating if recommended
• Maintain your own health insurance and emergency contact information
• Report any injuries or incidents immediately to program staff

Our Responsibilities:

• Provide qualified instructors with appropriate certifications
• Maintain safe facility conditions and equipment
• Offer appropriate modifications for different ability levels
• Respond promptly to safety concerns or incidents
• Provide clear program guidelines and safety instructions

You understand that we are not medical professionals and cannot provide medical advice. Our wellness guidance is for general health and fitness purposes only and should not replace professional medical care.

5. Payment Terms and Cancellation Policy

Payment for our services is due at the time of enrollment unless other arrangements have been made. We accept various payment methods and offer flexible payment plans for qualifying participants.

Payment Policies:

• Full payment is required before program participation begins
• Payment plans must be approved in advance and may include additional fees
• All fees are non-transferable between family members or programs
• Late payment fees may apply to installment plans
• We reserve the right to suspend services for non-payment

Cancellation and Refund Policy:

• Full refund available if cancelled within 48 hours of enrollment
• Partial refunds may be available for medical reasons with documentation
• No refunds for voluntary cancellation after program commencement
• Credits may be issued for future programs in certain circumstances
• We reserve the right to cancel programs due to low enrollment

If we cancel a program, you will receive a full refund or credit toward another program of equal value. Weather-related cancellations of outdoor activities will be rescheduled when possible.

6. User Conduct and Community Guidelines

Kelunip is committed to creating a welcoming, supportive environment for all participants. We expect all community members to treat each other with respect, kindness, and consideration.

Expected Behavior:

• Treat all participants, staff, and facilities with respect
• Arrive on time and prepared for activities
• Follow program rules and instructor guidance
• Support and encourage fellow participants
• Maintain appropriate language and behavior
• Respect others' privacy and personal boundaries

Prohibited Conduct:

• Harassment, discrimination, or intimidation of any kind
• Use of inappropriate language or offensive behavior
• Disruption of programs or activities
• Violation of safety rules or ignoring instructor guidance
• Unauthorized photography or recording of participants
• Solicitation or promotion of competing services

Violations of our community guidelines may result in warnings, suspension, or permanent removal from our programs without refund. We reserve the right to determine what constitutes inappropriate behavior.

7. Intellectual Property Rights

All content, materials, programs, and intellectual property associated with Kelunip are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Our Intellectual Property Includes:

• Program designs, curricula, and methodologies
• Training materials, handouts, and educational resources
• Website content, graphics, and multimedia materials
• Kelunip name, logo, and branding elements
• Proprietary wellness assessment tools and tracking systems

You may not copy, distribute, modify, or create derivative works of our intellectual property without explicit written permission. Personal use of provided materials for your own wellness journey is permitted.

Any feedback, suggestions, or ideas you provide to us become our property and may be used to improve our services without compensation to you.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy. You also consent to receiving communications from us related to your program participation and our services.

Photography and Media Release:

From time to time, we may photograph or record program activities for promotional purposes. By participating in our programs, you grant us permission to use your likeness in promotional materials unless you specifically opt out.

You may request to opt out of photography at any time, and we will respect your privacy preferences while still allowing you to participate fully in our programs.

9. Limitation of Liability

To the maximum extent permitted by law, Kelunip and its staff, instructors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability to you for any damages shall not exceed the amount you have paid to us for the specific service giving rise to the liability. This limitation applies regardless of the legal theory on which the claim is based.

• We do not guarantee specific health or fitness outcomes
• We are not responsible for injuries resulting from pre-existing conditions
• We do not guarantee the availability of specific instructors or programs
• We are not liable for delays or cancellations due to weather or emergencies
• We do not guarantee the accuracy of third-party health information

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kelunip, its employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses arising from your use of our services or violation of these Terms.

This includes but is not limited to legal fees and damages resulting from your negligence, willful misconduct, or breach of these Terms. You also agree to indemnify us for any claims arising from the participation of your family members.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

11. Force Majeure

We shall not be liable for any failure or delay in performance of our services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, epidemics, labor disputes, or technical failures.

In such circumstances, we will make reasonable efforts to resume normal operations as quickly as possible and may offer alternative arrangements or credits for affected services.

12. Dispute Resolution

We encourage open communication and will work with you to resolve any concerns or disputes informally. If formal dispute resolution is necessary, you agree to the following process:

Resolution Steps:

1. Direct communication with program staff or management
2. Written complaint submitted to our administration
3. Mediation through a mutually agreed upon mediator
4. Binding arbitration if mediation is unsuccessful

Any arbitration shall be conducted under the rules of a recognized arbitration association. The arbitrator's decision shall be final and binding on both parties.

These Terms shall be governed by the laws of the jurisdiction in which our primary business is located, without regard to conflict of law principles.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects our intent.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Kelunip regarding your use of our services.

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any provision shall not constitute a waiver of that provision.
